The OSCE Presence in Albania is implementing the Extra Budgetary project "Supporting a More Effective Administration of Justice in Corruption and Organised Crime Cases in Albania through Trial Monitoring", which will focus on supporting a more effective administration of justice with regards to serious corruption and organized crime cases in Albania. The project is currently in the six-month inception phase which started on 1 January. To ensure all trial monitoring staff are knowledgeable about the specificities of the relevant local legal framework and procedures regarding OCC cases, the Presence will hire one (1) local expert for a total of four (4) days to conduct a two (2) day training no later than the 4th week of September 2021. The training will be conducted online.
Objective of Assignment: This will be the final training prior to the implementation of trial monitoring in July of 2021. Previously, the monitors received training on the trial monitoring methodology and international fair trial standards delivered by ODIHR. The goal and result of this training will be that trial monitors are fully trained and prepared to perform their trial monitoring function in Albanian courts
Duration of Assignment: This consultancy is envisaged to happen during one week in September 2021.
Tasks and Responsibilities:
The Local Expert on Criminal Legislation and Procedures under the direct supervision of the Project Officer, and the overall guidance of the Head of Rule of Law and Human Rights Department, will prepare and deliver a two (2) day training to the project staff, specifically the Trial Monitors (NP1).
The work will include the following tasks:
Preparation of training for trial monitors, allotted preparation time is two (2) days;
Attending the preparatory online meeting with Project Manager
The training will focus on the monitoring of organized crime and corruption cases in Albania and will include relevant modules applicable to the duties of a trial monitor with particular focus on the Albanian legal framework pertaining to OCC, court procedure, appropriate courtroom behaviour and decorum for trial monitors, and trial monitoring best practices.
Preparation of a training guide and/or PowerPoint presentations for use during training, which will summarize the material covered. A copy will be retained by the OSCE Presence in Albania.
Delivery of training, which will be two (2) days in duration.
The incumbent should plan to deliver the training in a virtual setting
The trainer will deliver the following:
A two (2) day training to five trial monitors, one Project Assistant and the Project Officer.
A training guide and/or PowerPoint presentations for use during training, which will summarize the material covered.
Indicators of successful training: As a result of the training five (5) trial monitors will be prepared to monitor a minimum of 50 OCC cases during the 2.5-year implementation phase of the project. They will have a clear understanding of the Albanian legal framework and laws, rules and procedures applicable to OCC judicial proceedings.
An undergraduate degree in law is required, additionally an advanced degree is preferred;
A minimum of 5 years of relevant work experience, in one or a combination of the following positions: Legal practitioner working as judge, prosecutors, lawyer in the Albanian Court system, or lecturer in on criminal law and/or criminal procedure law.
Proven experience providing training and instruction.
Expertise with Albanian Criminal Law and Criminal Procedure Law;
Awareness of the current legal and political situation in Albania and its potential effect on trial monitoring would be an asset;
Computer literate with practical experience in Microsoft Word, Outlook and Excel;
Excellent written and spoken communication skills in English language;
Knowledge of Albanian legal terminology is required;
Ability to work with people of different nationalities, religious and cultural backgrounds;
Demonstrated gender awareness and sensitivity, and an ability to integrate a gender perspective into tasks and activities;
Working knowledge of English language is required
Remuneration will be based on the selected consultant’s/expert’s qualifications, experience, the tasks and deliverables for this position and in accordance with the OSCE established rates.
