As envisaged by the unified budget project "Strengthening capacities of Serbian institutions and civil society to tackle corruption, money laundering terrorism financing and economic crime", the OSCE Mission to Serbia will continue its efforts to support the work of specialized anti-corruption departments within the law enforcement bodies organized according to Law on Organization and Jurisdiction of State Authorities in Suppressing Organized Crime, Terrorism and Corruption (the Law). In 2021, three years after beginning the implementation of the Law, the Mission conducted an assessment of its practical implementation, related to the work of specialized anti-corruption departments within the prosecution and police. The Assessment received very good feedback from the Ministry of Justice, and it was included in the Action Plan for Chapter 23. The aim of this activity is to conduct an assessment of all four Specialised Departments for the Suppression of Corruption of Higher Courts with regard to their implementation of this law.

The OSCE Mission to Serbia’s Economic Crime & Anti-corruption Unit of the Rule of Law and Human Rights Department, in co-operation with the Security Co-operation Department, therefore requires the services of one local consultant (legal expert) who will, jointly with an international expert hired with the same purpose, conduct an impact assessment of the three-year implementation of the Law, related to the four Specialised Departments for the Suppression of Corruption of Higher Courts. The result of their work will be a comprehensive report containing analysis of the progress made, shortcomings, outstanding needs and recommendations on how to improve the work of specialised anti-corruption court departments. Additionally, the advantage of the report will be reflected in the combination of national and international perspective on the subject matter.

Tasks and Responsibilities

Under the supervision of the National Legal Officers from the two above mentioned departments of the Mission, the consultant will be responsible for:

Conducting research of the judicial practice in economic crime and corruption cases in the past three years related to the four Specialised Departments for the Suppression of Corruption of Higher Courts;
Developing standardized questionnaires for judges of the Specialized departments of Higher Courts;
Conducting in-depth interviews of judges in order to receive answers to the questions;
Analysing the data obtained during the interviews and present them as part of the assessment;
Drafting a comprehensive assessment report, containing up to 20 pages, summarizing the outcomes and key findings;
Presenting the final report at a round table discussion.

Necessary Qualifications

Citizenship of or permanent residence in the Republic of Serbia;
University degree in Law;
Minimum 10 (ten) years of experience in criminal matters;
Experience in working as a judge of a Serbian court;
Proven experience in conducting complex assessments in the field of Criminal Law;
Excellent knowledge of the Serbian judicial system;
Extensive knowledge of relevant comparative legislations and various national and international practices in the field of organised crime and corruption;
Professional fluency in Serbian; working knowledge of English;
Computer literate with practical experience in Microsoft packages;
Ability and willingness to work with people of different cultural, national and religious backgrounds;
Demonstrated gender awareness and sensitivity, as well as the ability to integrate a gender perspective into tasks and activities.

Remuneration Package

The consultant will be employed on a Special Service Agreement covering a total period of 15 (fifteen) working daysa in the period 1 June 2022 to 15 July 2022 and will be paid a total amount not exceeding 230,000 RSD in total, commensurate to individual qualifications and experience. The payment will be effected upon successful completion of all tasks.
